Digital Revolution: DELTA Act to Unlock the Treasury of Land’s Latent Value!

The state government is focusing on developing new sources of income to achieve the target of taking the state’s economy to 1 trillion dollars by 2030. Against this backdrop, the government is preparing the Maharashtra Digitisation and Exchange of Land Token Asset Act, or ‘DELTA Act’, to tokenize land and property in the state through blockchain methodology, transform their value into digital form, and build a digital mechanism for their transactions.

Chief Minister Devendra Fadnavis chaired an important meeting in Mumbai in July regarding the drafting of ‘The Maharashtra Digitisation and Exchange of Land Token Asset Act’. The value of immovable and movable property was considered at this meeting, and discussions were held on how to utilize it for public interest and state development. Maharashtra will be the first state in the country to propose such legislation. This will once again underscore the state’s leadership in digital governance.

What is the DELTA Act?

The DELTA Act is a new law proposed by the Devendra Fadnavis government to provide legal protection for the tokenization of land and property. Under this, using blockchain technology, different parts of land or land value can be bought and sold in the form of digital tokens, similar to the stock market.

A New Path to Income through Tokenization

The proposed ‘DELTA Act’ will take the purchase-sale and financial transactions of immovable property to an entirely new level. Through this act, the value of real estate will be converted into digital tokens and securely stored on blockchain technology. Globally, property tokenization is being used to find new paths to income; in the same manner, Maharashtra will build a digital mechanism for property transactions by issuing tokens based on land value using this technology. In the current traditional method, whether it is land purchase-sale or pledging property to banks for loans, all these tasks take considerable time. Blockchain-based tokenization will make this process extremely fast and transparent. This will allow common property owners to gain financial benefits from the latent value of their assets.

Checking Fake Land Documents

Through this use of technology, issues like fake documents, double sales, and ownership disputes in the real estate sector can be overcome. In the blockchain method, every transaction is recorded in a secure, time-stamped, and tamper-proof digital ledger. Since all this data is stored on the blockchain network, unauthorized changes to it are impossible. This will stop fraud in documents and help strengthen the confidence of citizens and financial institutions in property records. For these digital transactions to be safe and legally protected, work has been started at the administrative level from the Department of Urban Development, Law, and Justice to expedite the draft of this act.

Unlocking Latent Value of Property: Often land has a high value, but if the owner urgently needs money, they have to sell the entire land. But now through this tokenization, digital value can be added to small portions of land (tokenization), and the latent value can be utilized.
Faster and Transparent Purchase-Sale: The traditional land purchase-sale, registration, and loan obtaining process is very time-consuming and complicated. Blockchain technology will make this process digital, extremely fast, and transparent.
Transaction Like Stock Market: Just as there is liquidity in the stock market, through this platform, liquidity will come into real estate as well. Small investors will also be able to invest in property.
Legal Protection and Check on Fraud: Through blockchain technology, changing data or creating fake documents will become impossible. This will bring clarity to ownership rights of land, and these transactions will receive full legal protection.
New Investment Options: Through this act, the state will see a boost to blockchain and fintech startups, investors, and new technology. This act will be important in achieving the state’s goal of a 1 trillion dollar economy.

DELTA – A New Revolution in Digital Governance and Real Estate Sector

To ensure this act is comprehensive, legally sound, and error-free, an expert committee comprising SEBI, Bombay Stock Exchange (BSE), National Stock Exchange (NSE), legal experts, scholars, and startups will be established. Through the committee, the draft will be prepared by studying laws, regulations, and policies of the Government of India relevant to this subject that are prevalent worldwide. Currently, countries like England, Singapore, and Abu Dhabi have carried out property tokenization and have made platforms available for their purchase-sale. The focus of this initiative is to maintain balance in modern technology in administration, provide security to citizens’ property, and increase the state’s revenue. Maharashtra has a rich tradition of providing model laws to the country. In this regard, the Devendra Fadnavis government is making efforts. This act will be a new revolution in digital governance and the real estate sector.
