1% Parallel Reservation for Orphan Children in the Open Category
Orphaned children are deprived of parenting care and motivation and most often find the road narrowed down when it comes to establishing themselves in life. Devendra Fadnavis, wanting to boost their morale by providing higher education and job opportunities, initiated a 1% parallel reservation for orphaned children in the open category in Maharashtra in April 2018 when he was the CM of the state. This was another first-in-country act by the Fadnavis government that ensured opportunities for higher education and professional success for orphaned children.
Instructions for giving birth certificates to adopted children in orphanages
On January 8, 2001, the state government issued a notification to provide birth certificates for the children to be adopted from children’s homes and orphanages. Earlier, the Ministry of Home Affairs, Government of India, had issued guidelines for providing birth certificates to orphans by the Supreme Court order against Writ Petition No. 1971/82 on the necessity of birth certificates for the orphans admitted in government or government-owned children’s homes, orphanages, or observation homes.

Devendra Fadnavis government's decision
The Devendra Fadnavis government decided to issue orphan certificates to children admitted to government and non-government orphanages under the Juvenile Justice (Care and Protection of Children) Act. Accordingly, the District Women and Child Development Officer was ordered to provide orphan certificates to children without parents, issued by the superintendent of the institute where they are admitted. The Child Welfare Committee had also suggested that birth and death registration, school admission, and school leaving certificates should also be provided in addition to the orphan certificate. The decision was announced on June 6, 2016.

1% Parallel Reservation for Orphans
An important decision to provide 1% parallel reservation in the open category to the orphan children of the state was taken by the then Chief Minister Devendra Fadnavis in the cabinet meeting on 17 January 2018. Orphaned children face many difficulties in making a living after the stipulated period of their stay in an orphanage is over. They remain deprived of sufficient educational, financial, or social support from the government as their category isn’t specified for reservation. The Devendra Fadnavis government, for the first time in India, made it a law to provide higher education and job opportunities for orphaned children.

1% reservation in jobs and education
Under the Juvenile Justice (Care and Protection of Children) Act, 2015, orphaned and destitute children in need of care and protection are deprived of government benefits for the non-availability of caste certificates after leaving the institutes. Therefore, to help the orphaned children obtain various concessions from the state government, the Devendra Fadnavis-led government introduced 1% reservation in jobs and education under the open category. The decision was announced on April 2, 2018.

Orphans get special preference in government jobs

The decision to issue yellow ration cards to orphans
Orphans were issued temporary yellow ration cards, valid up to the age of 28 years, to provide them with the benefits of food grains as per the National Food Security Act. Change in the definition of orphans by the coalition government

Two-year extension for passing the typing test for orphan candidates
The government decided to allow the orphan category candidates 2 years and 2 opportunities to pass the typing test for government jobs. Generally, to be selected for a government service, a candidate must complete a course in MHCIT along with Marathi / English typing. After completing this course, you qualify for a job. There is a stipulated time frame for this. However, orphan candidates have been given 2 years to complete this. The government has also provided two opportunities to the orphan candidates to pass this exam.

Two categories of orphans
The Cabinet, in a meeting held on 23 March 2023, decided to implement a 1% reservation in new examinations to be held after 31 October 2022 in education and jobs for orphans by clubbing both A and B categories of orphan candidates into a new group called institutional and also renaming the C category of orphan children as non-institutional. A decision was taken to provide justice to both groups of orphan candidates by distributing job opportunities equally between the two groups.

Orphan reservation is also applicable in semi-government and government-aided institutions.
A government resolution dated April 6, 2023, approved the implementation of the 1% reservation for orphans in the state in education and recruitment in all types of government institutions, including semi-government and government-aided ones, on the lines of the disabled persons quota. Children who have lost both parents before attaining the age of 18 years and children who were raised in government homes are eligible for reservation in the institutional category.

Establishment of Research Committee for Orphans

Implementation of Parallel Reservation in Direct Recruitment
The reservation policy for backward classes is applicable in direct recruitment in the state. This is mainly based on castes, with the benefits being provided to Scheduled Castes (SC) Scheduled Tribes (ST) Denotified Castes (A) Nomadic Tribes (B) Nomadic Tribes (C) Nomadic Tribes (D) Special Backward Classes, Other Backward Classes (OBC) Economically Weaker Sections (given to Maratha community). Apart from this, the state government has implemented parallel reservations for some special categories. These include women, ex-servicemen, disabled people, sportspersons, project victims, earthquake victims, graduates, part-timers, and orphans. The state government decided to implement both types of reservations directly in government recruitment. The 1% reservation for orphans is a new addition to the list.

5 orphan boys appointed as PSI
The Devendra Fadnavis government decided to provide 1% reservation to orphan children in education and state government jobs in January 2018. In line with his promise, 5 orphan boys – Abhay Teli, Sudhir Chougule, Jaya Sontakke, Sundari Jaiswal, and Amol Mandve – joined the state police force and have reached the rank of PSI.
